Terms of Service & Privacy Notice

Plain-English summary: FreshVerdict is a software tool that reads I-9 forms and flags likely errors against published USCIS rules. We are not attorneys and nothing we produce is legal advice. Every finding is a first-pass check that you must verify against your original forms before acting. Your uploaded documents are processed in memory and discarded — we never store them.

1. What FreshVerdict Is (and Is Not)

FreshVerdict is an automated compliance software tool. It reads Form I-9 documents, applies deterministic checks against the U.S. Citizenship and Immigration Services (USCIS) Form I-9 rules currently in effect, and produces a structured findings report.

FreshVerdict is not a law firm. We are not attorneys. We do not provide legal advice, legal representation, or immigration counsel. Nothing in our reports, emails, website, or other communications constitutes or should be construed as legal advice.

For guidance on your specific legal situation — particularly anything involving potential knowing-hire liability, deportation exposure, or active ICE proceedings — you should consult a licensed immigration attorney or qualified employment counsel.

2. First-Pass Screening — Verify Before Acting

FreshVerdict reports are first-pass screening outputs. Findings are generated by automated reading of uploaded documents and the application of rule logic. While we design the rules engine to be accurate and current, automated document reading can misread handwriting, miss context, or produce false positives or false negatives.

Every finding must be independently verified against the employer's original Form I-9 before any corrective action is taken. FreshVerdict makes no warranty — express or implied — as to the completeness, accuracy, or fitness for purpose of any report. You bear full responsibility for the accuracy of your I-9 file and any corrections made.

3. No Warranty

The service is provided “as is” and “as available.” We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, uninterrupted, or that findings will reflect the most current USCIS guidance at the moment of delivery.

4. Limitation of Liability

To the fullest extent permitted by law, FreshVerdict's total liability to you for any claim arising out of or related to these Terms or the service is limited to the fees you actually paid for the specific order giving rise to the claim. In no event will FreshVerdict be liable for indirect, incidental, special, consequential, or punitive damages — including ICE penalties, fines, legal fees, or employment-related costs — even if advised of the possibility of such damages.

5. Customer Indemnification

You agree to indemnify, defend, and hold harmless FreshVerdict and its operators, employees, and contractors from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any law or regulation; or (d) any corrective action taken or not taken in reliance on a FreshVerdict report.

6. Acceptable Use

You may use FreshVerdict only for lawful I-9 compliance review of your own workforce. You may not: upload documents you are not authorized to process; use the service to facilitate document fraud; resell or sublicense access; or attempt to reverse-engineer the rules engine.

7. Monitoring Service

The reverification monitoring service tracks work-authorization expiration dates extracted from your I-9 audit and sends email alerts before those dates. Monitoring is delivered for three months at no additional charge with every paid full-file audit, after which it continues at $29/month (cancel anytime by emailing help@freshverdict.com). Monitoring is informational only — it does not perform reverification on your behalf and does not constitute legal advice.

8. Privacy & Data Handling

What we collect

When you purchase an audit: your email address and payment information (processed by Stripe — we never see full card numbers). When you upload I-9 forms: the document files you provide, plus the structured findings extracted from them.

Uploaded documents — process and discard

Uploaded I-9 scans (PDF, PNG, JPG) are processed in memory and permanently discarded immediately after extraction is complete. We do not store, retain, or archive your uploaded document files. Because I-9s routinely contain Social Security Numbers, immigration status, and other sensitive personal data, we treat elimination of storage as the strongest privacy protection we can offer.

Extracted findings

The structured findings (error codes, section labels, fix guidance) extracted from your forms are retained in order to deliver your report and reverification monitoring. They are handled as confidential employer compliance data and are not shared with third parties except as required by law or to deliver the service (e.g., email delivery via our transactional email provider).

Sensitive data

I-9 documents contain sensitive personal information including SSNs, immigration status, and work authorization documents. We do not log or index this data beyond what is necessary to produce your report. We do not sell, rent, or broker any data you provide.

Third-party processors

We use Stripe (payment processing), a transactional email provider (report and alert delivery), and Vercel (infrastructure hosting). Each operates under its own privacy terms.

9. Changes to These Terms

We may update these Terms from time to time. The effective date above reflects the most recent revision. Continued use after a revision constitutes acceptance.
